Brisbane Bus Lines P/L is authorised by Queensland Transport to operate buses and coaches under our authorisation number 100921.

1. Application
The conditions stated in this document apply whether a contract has been made in writing or verbally. The hirer contracts with Brisbane Bus Lines Pty Ltd upon behalf of the hirer and as the agent for all passengers travelling upon the vehicle/s. The hirer expressly warrants that they have the full authority of all passengers to enter into a contract on their behalf and to accept the conditions of hire. The hirer shall indemnify Brisbane Bus Lines Pty Ltd against any loss, claim damage, award or settlement which may be made against Brisbane Bus Lines Pty Ltd in excess of the exclusions and limitation of liability contained in these conditions of hire as a consequence of any lack of authority upon the part of the hirer to enter into a contract with Brisbane Bus Lines Pty Ltd.

2. Liability
Brisbane Bus Lines Pty Ltd accepts no liability for any act, omission or default, whether negligent or otherwise of any supplier. Brisbane Bus Lines Pty Ltd has no liability for any damage or loss caused by negligence, act or omission, of any supplier or third party. If liability cannot be excluded, the liability will be limited to the value of the contract price.

3. Quotations
a) Brisbane Bus Lines Pty Ltd will endeavour to respond to all quotations within two business days.
b) Quotations are given based on the route and information supplied by the hirer. If directions of the route are not specified, the most direct route will be used for the purpose of the quotation.
c) It is not compulsory for buses to have seat belts, except for new buses designed for long distance travel. It is recommended by Brisbane Bus Lines Pty Ltd that quotations involving travel outside the Brisbane Metropolitan area are based on seat belted vehicles.
d) Unless stated otherwise, all admission charges, meals, accommodation, vehicle parking charges and toll prices are not included in the quoted price.
e) Unless stated otherwise, all prices are expressed inclusive of GST
f) All quotations are given on the understanding that they are subject to a quoted vehicle being available if the quotation is accepted.
g) Unless quoted otherwise by Brisbane Bus Lines Pty Ltd the vehicle should not be assumed to remain at any point between outward & return Journeys or to remain available for the hirer’s incidental use when parked at such points.

4. Bookings
a) Brisbane Bus Lines will only confirm bookings once the hirer verifies in writing their acceptance of the quote and subsequently the terms and conditions here within.
b) If the hirer wishes to make amendments to the booking(s) Brisbane Bus Lines Pty Ltd will endeavour to accommodate the request. Any amendments are subject to availability at the time of processing and may incur extra charges.
c) If the hirer requires amendments to the booking whilst the charter is in progress, all amendments must be phoned through to the charter department, located at the Enoggera office. Any amendments are subject to availability at the time of processing and may incur extra charges.
d) In the event that the hiring group run late due to actions taken by the group which puts the driver in possible breach of transport regulations/statutory driving hours, the hirer will be responsible for any extra charges involved in the continuation of the charter as required by the group.
e) In the event that the hiring group run late due to circumstances out of Brisbane Bus Lines control which puts the driver in possible breach of transport regulations/statutory driving hours, the hirer must agree to follow instructions from Brisbane Bus Lines with regards to driver breaks or driver change overs.
f) Vehicle size is not guaranteed and is only an estimate based on information at the time of booking. Brisbane Bus Lines Pty Ltd can guarantee that vehicle(s) provided will accommodate the number of passengers specified by the hirer at the time of booking.
g) Unless otherwise agreed Brisbane Bus Lines Pty Ltd reserves the right to outsource tour and charter work when unable to undertake a booking due to vehicle or driver availability. This will not affect the quoted price.
h) Should the hirer detain a vehicle or a longer journey is taken, Brisbane Bus Lines Pty Ltd reserve the right to make additional charges to cover costs incurred.
i) If booked times are not adhered to Brisbane Bus Line Pty Ltd will give notice to the group that boarding must commence immediately. If group fails to board the vehicle Brisbane Bus Lines Pty Ltd reserves the right to withdraw the vehicle.
j) Brisbane Bus Lines Pty Ltd will not be liable for any loss or injury sustained by any passengers who fail to join a vehicle at the appointed time.
k) Equipment within the coaches (including but not restricted to: radios, air-conditioning, audio/video/CD/DVD Players, microphone, PA Systems, beverage facilities and toilet facilities) is provided at the discretion of Brisbane Bus Lines Pty Ltd unless otherwise requested by the hirer. Whilst every endeavour will be made to comply with the hirers requests Brisbane Bus Lines Pty Ltd cannot guarantee to meet any such request.
l) Brisbane Bus Lines representatives give advice on journey times in good faith and do not guarantee completion of any charter/journey in any specific time. Brisbane Bus Lines Pty Ltd will not be held liable for loss or inconvenience caused by the actual journey time and or breakdown of the vehicle.
m) Late night bookings may attract a $250 security bond. This must be secured against a credit card (visa or mastercard only) unless otherwise agreed with Brisbane Bus Lines. Brisbane Bus Lines Pty Ltd reserves the right to terminate the charter if the bond is not agreed upon, with no refund being due.
n) If applicable, Brisbane Bus Lines may request the hirer provide security guards on the vehicle(s). It is the responsibility of the hirer to organise and pay for the security guards. If security has been agreed upon, but fail to board on the night, Brisbane Bus Lines reserve the right to terminate the charter, with no refund being due.

5. Payments
a) Full payment must be finalised before travel, unless client books regularly with high frequency
b) Standard payment terms are 14 days from date of invoice, unless otherwise agreed with Brisbane Bus Lines Pty Ltd
c) All invoices must be finalised by their due date
d) Accepted payment methods are:
1.Electronic Transfer or Direct Bank Deposit
2.Credit Cards: Visa or Mastercard Only
3.Company Cheque / Money Orders
4.Cash payable at the Enoggera Office
e) Any professional costs or fees incurred as a result of Brisbane Bus Lines having to refer the file externally to a debt recovery agency and or solicitors will be borne by the client. These costs will be pursued until paid.

6. Cancellations
a) If the hirer wishes to cancel any booking they should advise us immediately by telephone and if requested by Brisbane Bus Lines Staff a confirmatory letter, email or fax to follow. Brisbane Bus Lines Pty Ltd shall be entitled to retain from payment already made or to recover, if not already paid, the balance of the total cost as follows:
1.Cancellations more than 24 Hours Notice – No Charge
2.Cancellations on the day prior to travel – up to 50% of the charter cost
3.Cancellations on site or once the job has commenced – up to 100% of the charter costs
b) In the event of any emergency, riot, civil unrest, strike, lock out, stoppage or restraint of labour or on the happening of any event over which the company has no control (including but not restricted to adverse weather and road conditions, mechanical failure) or in the event of the hirer taking any action to vary agreed conditions unilaterally, Brisbane Bus Lines Pty Ltd may by returning all money paid and without further or other liability cancel the booking.

7. Conduct of Passengers & Passenger Property
a) The Hirer must not load any vehicle beyond the number of passengers that it is legally permitted to carry. However, providing both Brisbane Bus Lines Pty Ltd & the hirer agree and the vehicle specifications allow, the following may be undertaken:
1).Primary or Pre-school children may be carried in a bench type seat bus designed for two adults if:
i. The seat is not fitted with seat belts;
ii. and/or The placement and construction of the seat allows it;
iii. and/or No child sits in the seat for more than 90 minutes while the two other children sit in the seat.
2).Standing passengers are permitted on buses only if:
i. The bus is specifically designed for the purpose, with hand holds and suitable floor space;
ii. No passenger stands for more than 20 Km; and
iii. The road has not been gazetted as a road not permitted for buses carrying standing passengers.
b) Passengers aged 16 years or older and not exempt from wearing a seatbelt must:
i. Occupy a seating position that is fitted with a seatbelt; and
ii. Must not occupy the same seating position as another passenger (weather or not the other passenger is exempt from wearing a seatbelt); and
iii. Must wear the seatbelt properly adjusted and fastened
The obligation on a driver to ensure that passengers comply with this does not extend to bus/coach drivers.
c) The driver is responsible for the safety of the vehicle. Any passenger whose conduct is in breach of statutory regulations may be removed from the vehicle or prevented from boarding on the drivers’ authority.
d) Persons under the influence of intoxicating liquor or drugs who are likely to become objectionable or unruly towards other persons inside or outside of the vehicle; or passengers who may become sick or abusive may be refused carriage.
e) The hirer is responsible for the conduct of the passengers whilst on the vehicle. Any damage or excess cleaning caused by the passengers will be solely the responsibility of the hirer. Brisbane Bus Lines Pty Ltd reserve the right to charge the hirer or withhold bond monies if any damage, repairs or excess cleaning is caused during or as a result of the charter. Costs are to be paid as soon as amounts are determined. Vehicles are thoroughly checked before and immediately after all charters.
f) NO SMOKING is permitted in any Brisbane Bus Lines vehicles. It is against the law in Queensland to smoke on public transport. If the hiring group are found on the charter or at a later date to have been smoking, additional charges may be applicable.
g) NO ALCOHOL is to be consumed whilst on Brisbane Bus Lines vehicles. Special requests can be made, however Brisbane Bus Lines Pty Ltd reserves the right to refuse consumption on board. If permission is given in writing from Brisbane Bus Lines Pty Ltd for the group to consume alcohol on board, a security bond will be applicable. This is to be refund providing no damage or excess cleaning is required to the vehicle (see Bookings section K). If the group do not have authority to consume alcohol on board and are found on the charter or at a later date to have been drinking on board, extra charges may be applicable.
h) NO FOOD is to be consumed within any Brisbane Bus Lines vehicles. Except where medical reasons exist or written permission has been granted by Brisbane Bus Lines Pty Ltd.
i) The driver of a public passenger vehicle must allow a person who has a disability to take an assistance animal on the vehicle. Assistance animal means:
i. Accompanies a person who has a disability; and
ii. Is specifically trained to give help to the person in relation to the disability.
j) Passengers are not permitted to place any part of their body outside the vehicle whilst the vehicle is moving.
k) All vehicles are subject to restrictions as to their carrying capacity as imposed by statute. The hirer accepts that the driver shall be the sole judge as to whether and to what extent passenger luggage and effects can be carried. No one piece of luggage is to exceed 20 Kgs.
l) Brisbane Bus Lines Pty Ltd shall not be held liable for any loss or damage of baggage or effects. In any event where Brisbane Bus Lines Pty Ltd is found by any Court of Law as responsible or negligent the liability is limited.
m) Brisbane Bus Lines Pty Ltd are not responsible for any damage to or loss of any property left upon the vehicle by a passenger whether or not with the knowledge of Brisbane Bus Lines Pty Ltd, its employees or agents. All articles of lost property recovered from the vehicle will be held at the Enoggera depot for a maximum of three (3) months.

7.General Terms & Conditions
Brisbane Bus Lines Pty Ltd cannot guarantee that all the facilities and equipment described on the Brisbane Bus Lines web site will be available. The photographs and descriptions used are examples of the facilities and equipment used for a type of service(s) or event.

8.Complaints
Any complaints in respect of the company’s services should be made in writing to the company’s office within fourteen (14) days of the completion of the charter.

9.Prohibited Items
a) Decorations (unless written consent has been given)
b) Alcoholic Beverages (unless written consent has been given)
c) Smoking
d) Glass containers
e) Golf shoes or other shoes with spikes
f) Fuel containers or Gas bottles
g) Generators
h) Fire Arms or any other weapons (unless written consent has been given e.g. Defence Force personal)
